What to Do if You’re Caught for a DUI

Written by: The Law Offices of Garrett T. Ogata

Las Vegas is a city with a reputation for partying, and heavy consumption of alcohol comes with the territory. It’s no wonder that the number of Nevadans subject to a drunk driving arrest is far higher than average. The punishments are severe, so being proactive is key if you want to be acquitted. The first step is to avoid drinking and driving in the first place. Assuming you did drink and drive, and you’re being pulled over, there are several behaviors you should avoid. First, it is important not to be rude when addressing the officer. Anger is a sign of intoxication, and it’s generally a bad idea when talking to an administrator of the law.

Do not resist a breathalyzer test. By holding a driver’s license, there’s an implied consent to one at the officer’s request. However, it is not necessary for you to say anything. Your Miranda rights make this clear, so don’t give them any more leverage in court than they already have. Simply request a lawyer, hopefully one from a firm of experienced Las Vegas DUI attorneys, and then keep everything else between you and your lawyer. After that, all you can do is try to remember the details of the incident, including any rights you feel were violated, and your attorney will work with you to attempt an acquittal or reduced penalty.
