The Issues Women Face When It Comes to DUIs

Written by: The Law Offices of Garrett T. Ogata

It’s sad, but true, that women have a number of disadvantages, when it comes to a DUI charge. Driving under the influence is illegal for both men and women, but, as the law stands right now in Nevada and elsewhere, it’s a bit biased against women. If you’re a woman who’s been arrested for a DUI, and charged, this bias is why you need to seek the counsel of an experienced Las Vegas DUI attorney as soon as possible. What exactly is the problem? The first issue is that field sobriety tests and the law were designed for men, not women. The legal limit for BAC, or blood alcohol content, was based on how much alcohol men could theoretically handle before becoming too dangerous on the road.

Unfortunately, women’s lung capacities are smaller than men’s, and breathalyzer tests are not engineered to accurately determine the blood alcohol level of women. In other words, they read women’s BAC as higher than it really is. At the same time, officers are generally not trained to accurately assess women’s intoxication levels for a DUI. The sum total of women’s lesser ability to break down alcohol, combined with an inherently biased system for judging their level of intoxication, means that it’s up to a qualified Las Vegas DUI lawyer to help defend women against this injustice. If you or a loved one has been arrested for a DUI, it very well might have been an unfair charge, and you’ll be glad to have a Las Vegas DUI attorney on your side.
