What to Do If You Are Pulled Over

One of the biggest mistakes most people make when they are stopped by police is talking too much. Inevitably, a person will end up saying something that will get them into more trouble than whatever they were initially stopped for. You do not have to (and generally should not) answer questions during a traffic stop. 

For example, if you were drinking and driving, it is not in your best interest to tell the officer that you had two drinks two hours ago. That gives the officer reasonable suspicion that you were driving under the influence of alcohol. Instead, stay calm and remember that you are not under any legal obligation to answer questions. 

Be Polite and Cooperative

You should not get combative with a police officer. Once you are pulled over, take a deep breath, and collect yourself. When the officer arrives at your window, they will likely ask you to provide your license and registration. 

Failure to comply with this request could have legal ramifications. It is a good idea to have these documents out and ready so that you are not fumbling for them while the officer watches. The officer may ask you questions such as if you know why you pulled over. You are not obligated to answer this question, and you may incriminate yourself if you do.

Consenting to a Search

Another mistake many people make is consenting to a search and seizure. You do not have to consent to your vehicle being searched. If the officer asks, you can politely decline. It is worth noting that they may be able to search your vehicle pursuant to an arrest, but you do not have to let them search it during the initial pull over. 

A search may reveal contraband you may or may not have known was in your vehicle. If you consent to a search prior to arrest and they find the contraband, they can now make an arrest. 

Final Thoughts

If you are pulled over, you can always ask whether you are being placed under arrest or if you are free to go. If you are placed under arrest, you can and should request an attorney. Do not make a statement until you have spoken with your attorney.
