“Not Guilty” on Several Felony Counts

A robbery suspect represented by Attorney Ogata faced 16 counts after his alleged involvement in a home invasion. According to 8 News Now, on May 20, the suspect entered the Las Vegas home of a childhood friend with another man holding the homeowner and three others at gunpoint.

The alleged armed robbers gathered valuables, including cash, clothes, and jewelry, before leaving the home. Both men were subsequently arrested and charged with a multitude of offenses, including robbery, first-degree kidnapping, battery, and assault. Most charges included penalty enhancements for the use of a deadly weapon.

The Severity of the Offenses

Many of the charged offenses were serious felonies. If convicted, the suspects would face years in prison. Residential burglary alone is considered a category B felony, punishable by up to 10 years in prison. Residential burglary while in possession of a deadly weapon increases the maximum prison sentence to 15 years.

With the dedicated, aggressive representation provided by Attorney Ogata, the suspect was found “Not Guilty” of the following charges:

  • 1 count of residential burglary while in possession of a deadly weapon
  • 3 counts of robbery with use of a deadly weapon
  • 3 counts of first-degree kidnapping with use of a deadly weapon
  • 2 counts of grand larceny of a firearm
  • 1 count of grand larceny
  • 1 count of conspiracy to commit robbery
  • 1 count of conspiracy to commit kidnapping
  • 1 count of battery with use of a deadly weapon
  • 1 count of assault with a deadly weapon

The defendant was found guilty of possession of stolen property and carrying a concealed firearm or other deadly weapon. As a result, the penalties the suspect faced were substantially less compared to if he had been found guilty of all charges.

Fighting Burglary and Robbery Charges in Las Vegas

Burglary and robbery charges are heavily prosecuted in Las Vegas. Many prosecutors will seek harsh penalties in order to punish the alleged offender. Depending on the situation, a person convicted of robbery with the use of a deadly weapon could face a prison sentence of 1 to 20 years.

Defending against these offenses can be difficult. Robbery is considered a crime against a person, not just property. It is also considered a violent crime. As defined by NRS 200.380, robbery involves the unlawful taking of another person’s property in their presence, against their will, and with the use of force or threat of violence.
