Las Vegas 6 Month Moratorium on Medical Marijuana

Written by: The Law Offices of Garrett T. Ogata

The City Approved a 6 Month Moratorium On Medical Marijuana Business Licenses

This moratorium is to figure out how to license and zone the new form of business.

What this implies is that Las Vegas will not treat medical marijuana dispensaries like any other regular business. One might expect further zoning requirements than what is already required by the State of Nevada for a medical marijuana license.  See Medical Marijuana Dispensaries.

One will have to be in compliance with local authorities to get a state license, so this means anyone who will be applying will have to be in compliance with the City of Las Vegas.  The State requires applicants to be in compliance with all local ordinances and rules pertaining to zoning, land use and signage.  See Choosing A Medical Marijuana Dispensary.  Since medical marijuana dispensaries will be new to the City of Las Vegas, politicians will take this as an opportunity to do what they tend to do, regulate.

Since location will play a huge part in getting an application approved with the state, one will either have to gamble or hold off on buying or leasing a property within Las Vegas to ensure they will be in compliance with local zoning.

Hopefully the City of Las Vegas will have this sorted out before the State starts taking applications.
