刑罰は、DUIの種類によって異なります。DUI #1(軽犯罪)は2日以上6ヶ月以下の実刑判決が出され、DUIスクールや被害者インパクト・パネル(VIP)、そしておよそ600ドル~1000ドルの罰金といった、費用のかかる刑罰になります。

DUI #2(軽犯罪)は、10日以上6ヶ月以下の実刑判決が出され、他にもVIP、エンジン作動ロック、罰金、そして1年以下のカウンセリングを受ける可能性もあり、費用がかかります。

DUI #3は重罪で、最低でも1年、最高で6年まで刑務所に入ることになります。その上、DUIの罪から実質的な身体的危害が生じた場合は、刑罰がより厳しく、一般的に2年から15年のより長い懲役刑とより高い罰金が科せられます。もし、DUIにより死者が出た場合は、真相によっては終身刑を受けることにもなります。

DUIで罪に問われた場合は、車を運転する特権をも危険にさらされます。DMVの行政審判を要求しない限り、DMVは運転免許と運転する特権を自動的に無効にするでしょう。DUI #1なら90日間、DUI #2なら1年、DUI #3なら3年以上、運転免許が失われます。SR-22の保険を持つことも義務付けられるでしょう。


Driving Under the Influence


In the state of Nevada, one can be charged with Driving Under the Influence (DUI) in multiple ways.  If your blood alcohol content (BAC) is .08 or higher, and you are driving or in physical control of a vehicle, such as sleeping in the driver’s seat with the keys in the ignition, then you can be charged with a DUI.  Also, if you are driving or in physical control of a vehicle and you have a certain level of prohibited substance, such as cocaine or marijuana in your system, then you can be charged with a DUI.  Even if you have a controlled substance, such as prescribed medication, or a BAC lower than .08, you can still be charged with a DUI under the “impairment theory.”  If you have a commercial driver’s license then you can be charge with a DUI if your BAC is only .04.  If you are under the age of 21, you can be charged with a DUI if your BAC is only .02.

The penalties vary for DUIs.  A DUI 1st (misdemeanor) carries a jail sentence of not less than 2 days nor more than 6 months in jail and costly penalties such as DUI school, Victim Impact Panel (VIP) and fines approximately $600-$1000.  A DUI 2nd (misdemeanor) carries not less than 10 days nor more than 6 months in jail and other costly penalties, such as VIP, breath interlock devices, fines and possible counseling up to 1 year.  A DUI 3rd is a felony and carries a minimum of 1 year in prison and a maximum term of not more than 6 years in prison.  Furthermore, if substantial bodily harm results from any DUI charge, the penalties are more severe and it carries longer prison terms, typically 2 to 15 years and higher fines.  If death results from a DUI you may be looking at a life prison sentence depending on the facts.

Your driving privileges are also at risk if you are charged with a DUI.  The DMV will revoke your license and driving privileges automatically unless you request a DMV administrative hearing.  You will lose your license for 90 days if it is a DUI 1st, 1 year if a DUI 2nd and 3 years or more if a DUI 3rd.  You will also be required to carry SR-22 insurance.

As you can see a DUI is a serious charge, but you do have rights and defenses.  It is important to seek legal counsel to inform you of the charges, your rights and defenses.  Your attorney will also need to request a DMV administrative hearing immediately to request a temporary license.  It is also important to know that you are not required to perform a Standardized Field Sobriety Test in Nevada nor make any admissions to drinking.  Always invoke your right to remain silent and to have your attorney present.  If law enforcement does arrest you for a DUI then you will be required to submit to a breath test or blood test.  Breath test are known to malfunction and prone to operator error, which may provide your attorney with additional defenses.  Clearly a cost of a cab ride is much safer, less traumatic and cheaper than getting a DUI.  It is best to never drink and drive.
