I Lost My License After a Traffic Violation. Can an Attorney Help?

Fighting a License Suspension or Revocation in Nevada

In Nevada, if you receive too many traffic violations within a 12-month period, your license will be suspended for six months. The Nevada Department of Motor Vehicles (DMV) assigns demerit points based on the type of traffic offense. If your license is suspended, you have the right to a hearing to stop the automatic suspension of your license.

At the Law Offices of Garrett T. Ogata, we represent individuals who have been charged with one or more traffic violations. We can represent you in court and at the DMV administrative hearing. If you have been accused of a traffic violation and face a license suspension, contact our office at (702) 840-5062 to get free legal advice.

Traffic Violation Demerit Points

The Nevada Department of Motor Vehicles assigns demerit points based on the type of traffic violation. It is important to note that there are no demerit points for “major traffic offenses” such as driving under the influence (DUI) as they will result in the automatic suspension of your driving privileges. Demerits can raise your insurance premium, and failing to deal with traffic violations can result in a bench warrant being issued for your arrest.

In general, it is in your best interest to contact an attorney as soon as you receive a traffic ticket. A traffic violations attorney can not only appear on your behalf in court, but they may also be able to get your ticket reduced to a non-moving violation or dismissed altogether. Non-moving violations and parking tickets are not assigned demerits through the DMV.

Traffic Offenses and Demerit Point Values

Moving violations are all assigned a demerit point value based on the severity of the offense. Depending on how many points you have accumulated, it may be in your best interest to attend traffic safety school. However, if you are required to attend traffic school as a condition of your plea agreement, it will not count towards removing demerits from your record.

Common traffic offenses and their demerit point value include:

  • Speeding 1 to 10 mph over the posted speed limit – 1 point
  • Speeding 11 to 20 mph over the posted speed limit – 2 points
  • Failure to dim headlights – 2 points
  • Following too closely – 4 points
  • Disobeying a traffic signal or stop sign – 4 points
  • Reckless driving – 8 points

Why Hire an Attorney

Twelve demerit points within a 12 month period will result in the automatic suspension of your driving privileges for six months. Without the help of an attorney, you will almost always have to serve the full suspension. Driving on a suspended license is a serious offense with criminal penalties.

A lawyer can represent you at an administrative hearing to stop the automatic suspension of your license based on too many demerit points. At the hearing, evidence can be presented on your behalf to show that the suspension is not warranted. Additionally, an attorney may help you to obtain a restricted license.
