*Contact an attorney immediately. If you plan on using representation, you must call him as soon as possible after your arrest to improve your chances of success.
*You have SEVEN DAYS to contact the DMV to request a hearing. This preliminary hearing gives you and your attorney a chance to contest the grounds on which you were arrested. The outcome of this hearing determines whether your case continues on to criminal court.
*You should have a received a temporary license at the time of your arrest. This license is valid for 7 days, allowing you to continue driving while awaiting the outcome of your preliminary hearing.
*All hope is not lost. It’s a common myth that DUI cases can’t be won. Nothing could be further from the truth. By acting promptly, and hiring expert representation, you stand a much better chance of overcoming this challenge.
The Charges:
One of the first questions you’ve probably asked yourself is “What penalties could I be looking at?” Bearing in mind that penalties vary based on several factors, here are the guidelines set out by the State of Nevada for a first offense:
2 day to 6 months jail sentence or community service requirement
Impounding of vehicle
Fines: From $340 - $1175
Mandatory participation in “Victim Impact Panel”
Probation.
Penalties are significantly increased if this a second or higher offense within seven years. Third offenses (within a 7 year period) are upgraded to felony status, as are any accidents that involve injury to or death of other people, regardless of prior history.
